Texas Civil Appeals Attorney
Pre-Trial Appeals | Interlocutory Appeals | Post-Judgment Appellate Disputes
In litigation, controversies of law can arise before or during the course of trial. In some instances, the court will find it necessary to resolve a dispute of law before trial begins. In other instances, it may be necessary to obtain a ruling of law from a higher court in the middle of a case, before the case can move forward. In most instances, however, as long as counsel has preserved error properly, the actual appeal commences post judgment.
If you are a trial attorney and have issues of law that must be settled, you will likely want to bring in an experienced appellate attorney. The strategies and procedures in a civil appeal differ dramatically from those at trial. You may lack the experience, the time or simply the inclination to personally handle appellate issues. We can help.
At Bailey & Galyen, we have 40 years of experience protecting the rights of petitioners and respondents in civil appeals in the state courts in Texas. We place a priority on communication, responsiveness and accessibility. We will stay in close contact with you throughout the process, keeping you informed of all developments in the appeal, and advising you of your options, so that you can make good decisions about how you want to proceed.

We Handle Appeals at Any Stage of the Process
We can step in and handle an appeal at any stage of the litigation process, including:
- Before a trial begins – We take appeals involving any pre-trial matter in which the court has made an error of law. This includes a broad range of motions, such as summary judgment motions.
- While a case is in process – We represent clients in interlocutory appeals, where an issue of law must be resolved while a case is underway. This can include a plea to the jurisdiction where a governmental entity is involved as a defendant, as well as appeals from an order that:
- Appoints a receiver or trustee;
- Overrules a motion to vacate an order that appoints a receiver or trustee;
- Certifies or refuses to certify a class in a suit brought under Rule 42 of the Texas Rules of Civil Procedure;
- Grants or refuses a temporary injunction or grants or overrules a motion to dissolve a temporary injunction;
- Denies a motion for summary judgment that is based on an assertion of immunity by an individual who is an officer or employee of the state or a political subdivision of the state;
- Denies a motion for summary judgment that is based in whole or in part upon a claim against or defense by a member of the electronic or print media, acting in such capacity, or a person whose communication appears in or is published by the electronic or print media, arising under the free speech or free press clause of the First Amendment to the United States Constitution, or Article I, Section 8, of the Texas Constitution, or Chapter 73;
- Grants or denies the special appearance of a defendant under Rule 120a, Texas Rules of Civil Procedure, except in a suit brought under the Family Code
- Post-judgment appeals – If your trial is over and you believe there were errors of law that contributed to or caused an unfavorable verdict, we can take your client through the entire appeals process. We will carefully review all matters related to the trial to ensure that there was reversible error by the trial court. We will fully research the issues of law and prepare and submit a persuasive brief to support your position. We will also be your oral advocate when the appellate tribunal hears your case. We also handle all types of post-judgment motions, including motions for a new trial, motions for judgment notwithstanding the verdict, and motions to disregard certain portions of a verdict.
