In Texas, the presumption is that both parents will be joint managing conservators (commonly referred to as custody) and make critical decisions about the child’s life, including where the child will reside. There are limited situations where a court can grant one parent sole legal custody (now known as sole managing conservatorship), but the general preference is that both parents have meaningful involvement with, and access to, minor children.
