Did you or someone you know come into the United States undocumented as a child? Are you protected from deportation under DACA (Deferred Action for Childhood Arrivals), an immigration policy instituted by former President Obama? Did you have a work authorization under DACA (also known as “the Dream Act”)? Do you have an employee who was protected under DACA? There’s good news, but you may need to take action to protect your right to stay in the United States. The attorneys at Bailey & Galyen can help.
At Bailey & Galyen, we provide comprehensive legal counsel to individuals, as well as small businesses, in matters related to immigration, including rights under DACA. We offer an insider’s understanding and perspective on a wide range of immigration matters. We’ll take the time to learn the details of your situation and will keep you fully involved and informed at all times so that you can make the right decisions to protect yourself and your future.
Protecting Individuals with Rights under the Dream Act (DACA)
Though the current administration temporarily rescinded the protections granted under DACA, a federal court has ordered that the program be reinstated. However, you will need to take specific action to protect your status:
- If your DACA protection was withdrawn or terminated before September 5, 2017, you can request protection under DACA, but you’ll have to provide documentation proving that you meet eligibility requirements and you’ll have to file a new initial request.
- If your DACA status ended on or after September 5, 2017, you can submit a renewal request with USCIS.
The immigration attorneys at Bailey & Galyen can walk you through the process, helping you complete all necessary paperwork and compile all required supporting documentation. We work directly with individuals seeking to protect their status in the United States and will also advise and counsel businesses and business owners who have workers who qualify for DACA status.
In our comprehensive immigration practice, we represent individuals and business owners in all matters related to permanent residency status including applying for and obtaining necessary visas, challenging deportation or removal proceedings, and ensuring compliance with USCIS rules and regulations. We handle employment based and family based visa processes.
